PaymentSpencer Ivy Ltd uses SagePay's Secure Payment Processing system which accepts most major credit cards and debit cards. Spencer Ivy Ltd operates with due diligence and responsibility by compliance with all regulations as set out in The Data Protection Act 1998 In compliance with these regulations, we ensure that no customer details will be disclosed to third parties. You will be contacted if we find the card or address details to be incorrect. We recommend that you do not send cash through the post. Due to varying exchange rates, we will only accept currencies in British Pound sterling (GBP). Should you not wish to pay by debit or credit card, please contact us on the number provided on our Contact Us page and we will provide you with full details on alternative payment methods which include Postal Orders and Bank Transfers. All payments must be cleared before goods are dispatched. Should an item be listed as out of stock, Spencer Ivy Ltd may require that a deposit is paid up front, this will be negotiated upon the value and purchase of the item(s).

Back OrdersWe endeavour to keep stock of the listed items & indicate if any particular item/s are out of stock. Should an order be placed for item/s, which are not in stock, we will e-mail you immediately giving details of any shortages. At this point, you may cancel the order, cancel that part of the order, which is not available, or accept the alternatives we have offered. If you are prepared to wait, balances will be sent carriage paid. We always e-mail our customers confirming that orders have been despatched. We also send e-mails, when balances are sent. You will also be informed of the method of shipment.

Mail Order ServicesAt present, our stock control system is entirely manual. If you need a definite answer as to whether an item is in stock, please contact us. Wherever possible, orders received by mid-day of each trading day, will be despatched that same day (Excluding Saturday). Sometimes where we are expecting delivery of an item immanently, there may be a delay of day or so. Please note our carriers, CityLink, require a signature upon delivery of a parcel. If our carriers are authorised to leave a parcel without obtaining a signature, liability for any losses, following delivery falls to the customer. Where deliveries are to be made to addresses other than the card holder's address, we are obliged to follow additional security procedures which, depending on circumstances, may involve a slight delay. If your choice of delivery address is your place of work or business, please include the name of the business/place of work.
WarrantyWarranties are offered on batteries, motors and chargers exclusive of wear and tear and faults covered by misuse. The guarantee period for the battery, motor and charger is 2 years from the date of purchase. This guarantee does not include the misuse of our products such as that which deviates from the instruction given in our operation manual including but not exclusively, dropping the bike on to the handlebars, resulting in broken brakes or gears shifters, broken lights, worn brakes, punctured tyres etc. This guarantee does not include misuse of the battery such as not following the manufacturer's guidelines for charging, discharging and storing the battery.
Orders & SpecificationsNo order submitted by the buyer shall be deemed to be accepted by the seller unless and until confirmed by the sellers authorised representative. The buyer shall be responsible to the seller for ensuring the accuracy of the terms of any order (including any applicable specification) submitted by the buyer and for giving the seller any necessary information relating to the goods within a sufficient time to enable the seller to perform the contract in accordance with those terms. The quality, description and quantity of and any specification for the goods shall be those set out in the sellers quotation (if acceptable by the buyer) or the buyers order (if accepted by the seller). For any goods manufactured, the buyer shall indemnify the seller against all claims, loss, damages and expenses incurred or for any infringement of patent, copyright, design, trademark or other intellectual property rights for which the seller may become liable by following the requirements or specification supplied. The seller reserves the right to make any changes to the specification for goods without prior notice.
Force MajeureThe sellers shall not be held responsible for any delay in delivery or the non-delivery of the goods due to Force Majeure. However, the sellers shall advise the buyers immediately of such occurrence and within fourteen days thereafter, shall send notification to the buyers in writing, by means of a certificate issued by competent government authorities of the place where the accident occurs as evidence thereof. Under such circumstances the sellers, however, are still under the obligation to take all necessary measures to hasten the delivery of the goods. In case the accident lasts for more than ten weeks, the buyers shall have the right to cancel the contract.
Your statutory rights are not affected by any of the above terms and conditions.
